Introduction and Acceptance of Terms

These Terms and Conditions govern your access to and use of the Ocean Patches website, products, and services. By accessing, browsing, registering an account, or placing an order through our website, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must discontinue use of the website immediately.

Eligibility and Account Responsibility

Use of this website is limited to individuals who are at least eighteen (18) years old and legally capable of entering into binding contracts. By using this site, you confirm that you meet these eligibility requirements. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. Any unauthorized use, transmission of malicious code, interference with website functionality, data scraping, price manipulation, or misuse of the site is strictly prohibited and may result in account suspension or legal action.

Orders and Payment Terms

All orders placed through Ocean Patches are subject to acceptance and availability. Full payment must be received before production begins unless otherwise agreed in writing. Ocean Patches reserves the right to refuse, cancel, or limit any order at its sole discretion, including in cases of pricing inaccuracies, typographical errors, or suspected fraudulent activity. We are not obligated to honor incorrect pricing or product information caused by system or human error.

Custom Products and Manufacturing Variations

Most Ocean Patches products are custom-made and handcrafted. Due to the nature of the production process, minor variations in color, size, finish, or design may occur. A deviation of up to five percent (5%) from approved artwork or samples is considered acceptable and non-defective. Custom products cannot be guaranteed to be one hundred percent identical to digital proofs or samples, and such variations do not constitute grounds for cancellation, rejection, or refund.

Refunds and Returns

Refunds and returns depend on the type of product purchased. Non-custom, stock items may be returned within thirty (50) days of purchase provided they are unused, undamaged, and in original condition. Custom-made products are generally non-refundable. If you believe a product is defective, you must notify Ocean Patches within seven (7) days of receipt. Returned items are subject to inspection prior to any refund or replacement. If defects exceed acceptable manufacturing tolerances, Ocean Patches may, at its discretion, remake or replace the affected products. Variations within acceptable handmade tolerances are not considered defects.

Order Cancellation

Non-rush orders may be canceled prior to the start of production. Production is deemed to have begun once tooling, molds, or setup processes have started. If cancellation occurs after production has begun, you may be responsible for incurred setup, tooling, or production costs. Once full production has been completed, cancellations and refunds are no longer available. Credit card cancellations may be subject to a processing fee to cover transaction-related costs.

Shipping, Delivery, and Risk of Loss

All purchases are made pursuant to a shipment contract. Ownership and risk of loss transfer to you once the order is handed over to the shipping carrier. Ocean Patches is not responsible for delivery delays caused by customs inspections, shipping carriers, weather conditions, geopolitical events, regulatory changes, or customer-requested changes made after production has begun. Estimated delivery dates are provided for reference only and are not guaranteed.

Product Information and Pricing Accuracy

Product descriptions, images, pricing, and other content on the website are provided for general reference and may contain errors or inaccuracies. Ocean Patches does not guarantee that all content is complete, accurate, or current. In the event of a pricing or description error, we reserve the right to cancel the order or contact you for confirmation prior to fulfillment. For non-custom products that materially differ from their description, your sole remedy is to return the product in unused condition in accordance with our return policy.

Intellectual Property and Artwork Rights

By submitting artwork, logos, or other creative materials, you represent and warrant that you own or have obtained all necessary rights, licenses, and permissions to use such materials. You agree to indemnify and hold harmless Ocean Patches from any claims, damages, or legal actions arising from intellectual property infringement related to submitted content. All website content, designs, software, and proprietary materials remain the exclusive property of Ocean Patches and may not be copied, modified, reverse-engineered, or exploited without prior written consent.

Fraud Prevention

Ocean Patches actively monitors transactions and user activity for fraudulent behavior. Any suspected fraud may result in immediate order cancellation, account suspension, and pursuit of all legal remedies available. You agree to be responsible for any costs, damages, or legal fees arising from fraudulent activity associated with your account.

Disclaimer of Warranties

All products and services are provided on an “as is” and “as available” basis. Ocean Patches makes no express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the website will be uninterrupted, secure, or error-free, and we are not liable for any consequences resulting from such issues.

Limitation of Liability

To the fullest extent permitted by law, Ocean Patches shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, revenue, or data, arising from your use of the website or purchase of products. Our total liability shall not exceed the amount paid for the affected order or the maximum amount permitted by applicable law, whichever is lower.
